Welcome to Our Conversation

Today we’re talking to local conservatorship attorney Ted Cook from the firm Point Loma Estate Planning APC. Welcome, Ted!

Let’s Get Started: What Exactly Is a Conservatorship?

Ted Cook: Thanks for having me! Simply put, a conservatorship is a legal process where a court appoints someone to manage the affairs of an adult who can no longer make sound decisions for themselves. It’s all about protecting vulnerable individuals and ensuring their well-being.

Can You Walk Us Through the Conservatorship Process?

Ted Cook: Absolutely! I’ll give you a general overview, but remember every case is unique:

  • A. Types of Conservatorships
  • B. Establishing a Conservatorship
  • C. Legal Standards and Rights
  • D. Responsibilities of the Conservator
  • E. Modifying or Terminating Conservatorship

Let’s Focus On: ‘Establishing a Conservatorship.’

Ted Cook: That’s a crucial step! It all begins with someone filing a petition in probate court, usually a concerned family member or friend. Now, the proposed conservatee – the person who might need the conservatorship – has to be notified about the proceedings. The court will then appoint an investigator who meets with the individual and any relevant parties.

Medical or psychological evaluations are often required to assess the individual’s capacity. Based on all this information, a judge decides whether to grant the conservatorship.

“Ted helped my family navigate a truly difficult situation when my mother needed a conservator. He was patient, compassionate, and explained everything clearly.” – Susan K., La Jolla.

>”Point Loma Estate Planning APC. made a complex process feel manageable. I felt confident that they were advocating for my best interests throughout the whole conservatorship.” – Michael B., San Diego.

Any Challenges You’ve Faced During This Stage?

Ted Cook: “I remember this one case where the proposed conservatee was adamant about not needing help, even though it was clear they were struggling with dementia. Getting them to understand and accept the process was a delicate dance – it required building trust and showing genuine empathy.”

“Another time, we had difficulty locating family members for notification. Tracking them down involved some detective work, but ultimately we ensured everyone had a voice in the proceedings.”

More Facts About A Conservatorship:

A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.

Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.

Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.

What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.

There are generally two types of conservatorships:

Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.

Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.

In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
