Inventorying Estate Assets: A Crucial Step in Probate
Steve, could you walk us through one of the key steps involved in the probate process?
“Certainly,” says Steve Bliss. “One crucial step is marshaling the estate assets. This involves creating a comprehensive inventory of everything the deceased person owned at the time of their death.”
According to Steve, this inventory should include not just tangible items like real estate, vehicles, and personal belongings but also intangible assets such as bank accounts, investments, retirement funds, and even digital assets.
“Accurately identifying and valuing all assets is essential for several reasons,” explains Bliss. “Firstly, it helps determine if the estate exceeds the probate threshold, which in California is currently $184,500. Secondly, a thorough inventory ensures that all creditors are notified and have an opportunity to file claims against the estate.”
Steve emphasizes the importance of meticulous record-keeping during this stage. “I always advise my clients to gather as much documentation as possible – bank statements, property deeds, insurance policies, investment account summaries – anything that can help substantiate the value of the assets.”
Moreover, he stresses the need for transparency and accuracy when filing the Inventory and Appraisal with the court (Forms DE-160/161). “Any discrepancies or omissions can lead to delays and potential legal complications down the road,” cautions Bliss.

“Have you ever encountered any difficulties while assisting clients with this step?” I ask Steve.
He nods thoughtfully, recalling a particular case. “I once worked with a family whose patriarch had been an avid collector of rare coins and stamps. Locating and valuing these items required extensive research and consultations with specialists. It took time and effort, but ultimately we were able to present a complete and accurate inventory to the court.”
