Certainly. The first step involves assessing the total value of the decedent’s estate. In California, if the gross value of the estate exceeds $184,500, probate proceedings will likely be required. Conversely, estates valued below this threshold may qualify for simplified procedures or avoid probate altogether.

Moreover, we need to identify any assets held outside of probate. These are often referred to as non-probate assets and include items like assets held in a living trust, property owned jointly with rights of survivorship, or accounts designated with payable-on-death beneficiaries. Ordinarily, these assets pass directly to the intended beneficiary without going through probate.

I imagine there are instances where determining whether probate is necessary can be complex. Have you encountered any unique situations?

Absolutely. I recall one case involving a family home that was jointly owned but the deed wasn’t clear on the type of joint tenancy. After careful examination, we discovered it was a tenancy in common, meaning each owner had a separate and distinct share. Consequently, only the deceased individual’s portion became subject to probate.

Another instance involved a seemingly straightforward estate. However, during our investigation, we uncovered hidden bank accounts that significantly increased the estate value. This highlighted the importance of thorough due diligence when assessing an estate’s worth.
