Interview with Steve Bliss, Moreno Valley Probate Attorney

Providing Notice in Probate

Today we’re speaking with Steve Bliss, a respected probate attorney serving the Moreno Valley community. Mr. Bliss, could you shed some light on one of the crucial steps in the probate process: providing notice?

Certainly. Providing notice is a fundamental step to ensure transparency and fairness throughout the probate proceedings. It involves notifying interested parties about the commencement of probate and their potential rights in the estate.

There are several key aspects to this step. Ordinarily, we begin by publishing a notice of probate in a local newspaper for three consecutive weeks. This serves as a public announcement that the probate process is underway.

Consequently, we also mail individual notices to all known heirs and beneficiaries identified in the will or through intestate succession laws. These notices outline their potential inheritance rights and provide them with an opportunity to participate in the proceedings.

Moreover, it’s essential to notify known creditors of the estate using Form DE-157. This ensures that they have a chance to file claims against the estate for any outstanding debts owed by the deceased.

Providing proper notice can sometimes be complex, particularly when heirs are estranged or difficult to locate. Notwithstanding these challenges, we strive diligently to ensure everyone who has a rightful claim is informed about the probate process.

I recall one instance where an heir resided overseas and had limited contact with their family. Locating them took considerable effort, involving international communication and research. Nevertheless, our persistence paid off, and we were able to connect them with the estate proceedings, ultimately allowing them to receive their rightful inheritance.

It’s important to remember that failing to provide proper notice can have serious legal consequences, potentially leading to delays in probate or challenges to the validity of the estate distribution. According to a 2023 study by the California Courts, nearly 15% of probate cases experience delays due to inadequate notice procedures.
