Good evening, Moreno Valley, and welcome back to our program. Tonight, we’re speaking with local probate attorney Steve Bliss about estate planning and the various types of trusts available to residents.
Types of Trusts: Choosing the Right One
Steve, there are many different types of trusts. Can you give us an overview of some common ones and explain when someone might choose one over another?
“Certainly,” says Steve Bliss. “One type we see frequently is the Revocable Living Trust. This allows individuals to manage their assets during their lifetime while avoiding probate after they pass away. It also provides a level of privacy that a will doesn’t offer. Conversely, an Irrevocable Trust offers more robust asset protection but comes with less flexibility since it can’t be easily changed once established.”
“For those looking to leave assets to minor children or beneficiaries with special needs, a Testamentary Trust created through a will might be the best option. Ordinarily, these trusts go through probate, which ensures court oversight and proper distribution of funds,” adds Bliss.
Navigating Challenges: Real-World Experiences
Steve, we know that estate planning can sometimes be complex. Have you encountered any unique challenges when helping clients set up trusts?
“Absolutely,” Steve replies thoughtfully. “I recall working with a family who had inherited a significant piece of land but were concerned about potential future liabilities. We decided on an Irrevocable Trust to shield the property from lawsuits while still allowing them to enjoy its benefits. It was a delicate balance, and seeing their relief when we found a solution that addressed all their concerns was incredibly rewarding.”
“Another case involved a single mother with a young child who had a chronic illness. We created a Special Needs Trust to ensure her son would receive the care he needed without jeopardizing his eligibility for government benefits. Knowing we were helping secure his future brought me immense satisfaction,” he says, his voice softening.
According to a 2021 study by the American Bar Association, over 60% of adults do not have a will or trust in place. This highlights the importance of seeking professional guidance when planning for your legacy.
Protecting Your Future: The Importance of Trust Planning
Steve, what advice would you give to our viewers who are considering setting up a trust?
“The best thing you can do is consult with an experienced probate attorney,” Steve emphasizes. “We can help you determine which type of trust aligns with your individual needs and goals. Don’t wait until it’s too late – taking proactive steps to protect your assets and loved ones will provide peace of mind for years to come.”
“Moreno Valley Probate Law is dedicated to helping families navigate the complexities of estate planning with compassion and expertise,” says Bliss.
