Hello everyone, I’m here today with Ted Cook, an elder protection attorney based right here in sunny San Diego. Ted, thanks for taking the time to chat with me about this crucial topic.
What initially drew you to Elder Law?
It’s a pleasure to be here. What drew me to elder law was seeing firsthand how vulnerable older adults can be. I had family members who faced some challenges later in life, and it made me realize the importance of having someone to advocate for them.
“Ted helped my mother navigate a complicated financial situation after she was taken advantage of. He was patient, understanding, and truly fought for her best interests.” – Sarah M., La Jolla
Could you walk us through the steps involved in protecting an elder?
Absolutely! The process starts with what we call “Initial Client Engagement”. This involves a thorough intake consultation where we gather information about the individual’s situation, assess their mental and physical capacity, and identify any potential risks. Next comes “Case Assessment” – we delve deeper into the legal issues involved, collect evidence, and evaluate the level of risk.
Let’s dive deeper into “Protective Actions.” Can you elaborate on this stage?
“Protective Actions” is where we take concrete steps to safeguard our client. This could involve filing for restraining orders or protective injunctions if there’s a threat of abuse. We may also work with Adult Protective Services (APS) and initiate guardianship or conservatorship proceedings if necessary. Financially, we can help freeze accounts, revoke powers of attorney that have been misused, and prevent unauthorized property transfers.
- It’s crucial to act quickly in these situations because time is often of the essence.
- Remember, our goal is always to prioritize the elder’s safety and well-being.
“Ted provided invaluable guidance when my father was diagnosed with dementia. He helped us navigate the complex legal and financial decisions while ensuring my dad’s needs were met.” – John B., Point Loma
Have there been any challenges you’ve faced during this stage?
One case that sticks out involved a woman whose son had been mismanaging her finances for years. It took a lot of detective work to uncover the extent of the financial abuse, but ultimately we were able to recover a significant portion of her stolen funds. The relief on her face when she finally felt safe and in control again was incredibly rewarding.
“Ted’s expertise and compassionate approach made a difficult situation bearable for our family. He truly went above and beyond.” – Mary S., San Diego
