Ted, can you tell us a bit about yourself and what drew you to this particular field of law?
Well, thank you for having me. It’s great to be here. I’ve been practicing law for over 20 years now, and elder protection is something that truly resonates with me. I see firsthand the vulnerabilities seniors face and the importance of advocating for their rights and well-being.
It wasn’t a straight path. I started in family law but found myself drawn to cases involving senior clients facing exploitation or abuse. I realized there was a real need for compassionate legal representation that understood the unique challenges older adults encounter.
What are some of the common issues you encounter in your work?
There’s a wide range, unfortunately. Financial exploitation is a big one – scammers targeting seniors with promises of easy money or lottery winnings. Then there’s neglect, sometimes within families, where an elderly person isn’t receiving proper care.
Physical and emotional abuse also sadly occur, though they can be harder to detect. I always try to approach each case with empathy and a deep understanding that seniors deserve dignity and respect.
Let’s dive into one of the steps in the Elder Protection process. Can you elaborate on ‘Case Assessment’?
Case assessment is crucial because it sets the stage for everything that follows. Think of it like piecing together a puzzle – gathering all the necessary information to understand the situation fully.
- First, we need to clearly identify the legal issue at hand. Is it financial abuse, neglect, physical or emotional harm?
- Next comes evidence collection: interviewing the client, potential witnesses, and gathering relevant documents like medical records, financial statements, and care facility reports.
Finally, we evaluate the risk – how urgent is the situation, what are the potential dangers to the senior’s well-being? This helps us determine if immediate action, such as a restraining order, is necessary.
There must be some challenges in this stage, right?
You bet! Sometimes getting seniors to open up can be tough, especially if they fear repercussions from the abuser. Trust is paramount, and building that rapport takes time and patience.
